Inheritance – Compensation – Personal Injury – Electricity
This case involved compensation due to the heirs of a man who had died as a result of an electric shock. It was claimed the company should pay the compensation as they had failed to repair an electric column. The compensation should have been adjusted to reflect the fact one of the heirs was partly responsible for the accident.
Background
The heirs of a deceased man filed a case against a company before the civil court requesting the company pay them compensation for the damage. The heirs said that their father had died because of an electric shock and that company was responsible because it had failed to repair the electric column.
The court ruled that the company should pay the heirs moral and material compensation.
The company appealed the ruling before the court of appeal. The court amended the appealed ruling and ruled that the value of compensation should be decreased.
