This case involved a request by an employee to be reinstated. The employee had been acquitted in a criminal sexual harassment case. However, the employer was not required to reinstate him.

Background

An employee made a complaint against a company before the Ministry of Labour claiming that the company unfairly dismissed him from his job. The employee requested the company reinstate him. The Ministry referred the case to the court. The employee made another complaint claiming that the company had transferred him to another position and he did not reject this decision but the company dismissed him. The employee requested the company to pay him compensation and due entitlements.

The court ruled that the company should pay the employee 203.275 Dinars for annual leave and interest.

The employee appealed the ruling before the court of appeal. The court upheld the appealed ruling.
