Background
The heirs of a deceased man filed a case against an insurance company before the court requesting the company pay 5500 Dinars and interest as compensation for damage which had resulted from the death of their father in a car accident. The heirs said that the car was insured by the company.
The court ruled that the company should pay the heirs 25000 Dinars and 5% interest.
The heirs and the insurance company appealed the ruling before the court of appeal. The court dismissed the appeal made by the heirs, amended the appealed ruling and ruled that the insurance company should pay the heirs 12000 Dinars.
Decision
The heirs appealed the ruling before the court of cassation.
The insurance company argued that the appeal made by the heirs should be dismissed because it did not include the names of the disputes parties.
