This case involved a claim by an employee who had had to resign because of non-payment of wages for his dues. The key issue was whether this employer or another who had an employment contract with the employee should be liable for the amounts. The first employer should be responsible as the contract establishing the other company was after the date the employee started work.
Background
An employee made a complaint against an employer before the Ministry of Labour claiming that he was working for the employer but left the job because he did not get paid his wages. The Ministry referred the case to the court. The employee requested the employer to pay him his entitlements and compensation.
The employer claimed that another company had signed the employment contract with the employee and requested the addition of this company to the case.
The court dismissed the request made by the employer and ruled that the employer should pay the employee 734.94 Dinars plus interest and travel tickets.
The employer appealed the ruling before the court of appeal. The court dismissed the appealed ruling.
