This case involved an employee's rights on termination. It was confirmed whatever the reason for termination of employment the employee was entitled to be paid the value of a travel ticket.

Background

An employee made a complaint against a company before the Ministry of Labour requesting a company to pay his due entitlements and the value of a travel ticket and hand over his passport. The Ministry referred the case to the court.

The court ruled that the company should pay the employee 42 Dinars for annual leave and hand over the employee's passport.

The employee appealed the ruling before the court of appeal. The court upheld the appealed ruling.

Decision

The employee appealed the ruling before the court of cassation and said in his grounds of appeal that the ruling had violated the law because the court did not rule that the company should pay the employee the value of a travel ticket in violation to Article 7 of the Labour Law.
