The original dispute involved a request by an employee who had resigned because of non-payment of salary for his dues and return of his passport. An oath could not be requested on the issue of the passport because the employer had committed a crime in withholding it.
Background
An employee made a complaint against an employer before the Ministry of Labour claiming that he was working for the employer but he left the job because he did not get paid his wages. The employee requested the employer pay his entitlements and compensation. The Ministry referred the case to the court.
The court ruled that the employer should pay the employee 546.885 Dinars and a travel ticket.
The employee and the employer appealed the ruling before the court of appeal. The court amended the appealed ruling and ruled the employer should pay the employee 731.707 Dinars.
