Background
An employee filed a case against an employer before the labour court requesting the employer to pay his entitlements and the value of a travel ticket and hand over his passport.
The court ruled that the employer should pay the employee 230.242 Dinars.
The employee appealed the ruling before the court of appeal. The court dismissed the appeal and upheld the appealed ruling.
Decision
The employee appealed the ruling before the court of cassation and said in his grounds of appeal that the ruling had violated the law because the court did not order the company to pay him the value of the travel ticket although he deserved to get paid this under Article 7 of the Labour Law.
The court said that this argument was invalid because the court had established its ruling based on the fact that the employee had started working with another employer and he did not deserve to get paid the value of a travel ticket.
The court dismissed the appeal.
