This case involved a claim by an employee who had had to retire because of a workplace injury for treatment costs and an end of service gratuity. The court had agreed it was a workplace injury but had ignored the contract which specified their dues in this case.
Background
An employee made a complaint against a company before the Ministry of Labour claiming that he was working in the company until his early retirement. The employee said that he got sick during his work and he was still getting treatment but the company had refused to pay the treatment expenses. The Ministry referred the case to the court. The employee added another defendant to the case requesting the company and the defendant to pay the treatment expenses and the end of service gratuity.
The court dismissed the case.
The employee appealed the ruling before the court of appeal. The court dismissed the appeal and upheld the appealed ruling.
