BCC 524/2006

This case involved a claim by an employee for compensation. It was wrong for the court of cassation to reconsider a final decision by the court of appeal on the amount owed by the employer.

Background

An employee made a complaint against a company before the Ministry of Labour claiming that the company had unfairly dismissed him from his job. The Ministry referred the case to the court. The employee requested the company to pay him 76209 Dinars in compensation.

The court dismissed the case.

The employee appealed the ruling before the court of appeal. The court dismissed the appealed ruling and ruled the company should pay the employee 20000 Dinars for compensation.

Decision

The company appealed the ruling before the court of cassation. The court of cassation repealed the ruling and referred the case to the court of appeal. The court amended the appealed ruling and ruled the company should pay the employee 10000 Dinars for compensation.
