BCC 490/2006

This case involved an employee's rights under a definite contract which had been renewed many times but then it was stated the employee was unfairly dismissed without notice. A key issue was whether the employee was exempt from paying appeal fees.

Background

An employee filed a case against a company before the court claiming that he was working for the company under a definite contract for two years and the contract was renewed many times after its termination. The employee said that he continued to work after the last termination of the contract but the company then terminated the contract without justification or giving notice. The employee requested the company to pay him compensation and his entitlements.

The court referred the court to the administrative court which dismissed the case.

The employee appealed the ruling before the court of appeal. The court rejected the appeal in form.
