This case involved the sale of a property which had not been completed. It was argued the defendants did not want to sell the property but use it as a guarantee. This was irrelevant as the defendants had endorsed the price of the house.
Background
A claimant issued a case against the defendants before the civil court claiming that the first defendant, as a representative of other defendants, sold them a disputed house but he failed to hand over the ownership deed. The claimant requested the defendants pay her rent for the house.
The court ruled that the defendants should pay the claimant the rent for the disputed period.
The defendants appealed the ruling before the court of appeal. The court upheld the appealed ruling.
