This case involved the entitlements of an employee whose employment was terminated. This employer was only liable to pay end of service gratuity and holiday pay for the period the employee worked for him and not for the period he worked for his partner.
Background
An employee made a complaint against an employer before the Ministry of Labour claiming that he was working with the employer under a fixed-term contract and that he continued working after the termination of the contract at the employer's request. The employee said that the employer had failed to pay his entitlements. The Ministry referred the case to the court.
The court ruled that the employer should pay the employee 296.876 Dinars for holiday pay and 167 Dinars for a travel ticket.
The employee appealed the ruling before the court of appeal. The court amended the appealed ruling and ruled the employer should pay 360 Dinars for annual leave in addition to 900 Dinars.
