This case involved dismissal of an employee because of absence. Failure to provide sufficient notice of dismissal did not prevent dismissal on the grounds of absence itself.
Background
An employee made a complaint against a company before the Ministry of Labour claiming that he was working for the company and was unfairly dismissed, The Ministry referred the case to the court. The employee requested the company to pay his entitlements and compensation for dismissal.
The court ruled that the company should provide the employee with a certificate of experience.
The employee appealed the ruling before the court of appeal. The court dismissed the appealed ruling and ruled the company should pay the employee 289 Dinars and 3% interest.
