Employee’s Rights – Salary – Termination of Employment – Overtime – Resignation – Holiday Pay – Evidence – Endorsement
This case involved money due to an employee who had been forced to resigned because of non-payment of salary. The court had been wrong to rule on holiday pay and overtime due which contradicted an endorsement by the company representative.
Background
An employee made a complaint against a company before the Ministry of Labour claiming that he was working in the company and the company had failed to pay his wages and he resigned. The Ministry referred the case to the court.
The court ruled that the company should pay the employee 540.309 Dinars and the value of a travel ticket and hand over his passport.
The employee appealed the ruling before the court of appeal. The court amended the appealed ruling and ruled the company should pay the employee 585.132 Dinars.
