Evidence – Employee’s Rights – Termination of Employment – Witnesses – Investigation – Unfair Dismissal
This case involved a claim by an employee for compensation after being unfairly dismissed. The employer claimed she was fairly dismissed because of absence. They had the right to request an investigation even though they had failed to provide witnesses to prove their case at the court of first instance.
Background
An employee made a complaint against an employer before the Ministry of Labour claiming that she was working for the employer and was dismissed from her job without justification. The employee requested the employer pay in lieu of notice and compensation. The Ministry referred the case to the court.
The court ruled that the employer should pay the employee 10690 Dinars for compensation and pay in lieu of notice.
The employer appealed the ruling before the court of appeal. The court upheld the appealed ruling.
