BCC 406/2006

This case involved a claim by an employee that they had been recruited from abroad but not provided a job. The employee had failed to provide witnesses at the appropriate time or evidence that they had an employment relationship with the employer.

Background

An employee made a complaint against a company before the Ministry of Labour claiming that the company recruited him from abroad but failed to offer him a job. The employee requested the company offer him a job or pay him compensation and the value of a travel ticket and 800 Dinars. The Ministry referred the case to the court.

The court dismissed the case.

The employee appealed the ruling before the court of appeal. The court upheld the appealed ruling.

Decision

The employee appealed the ruling before the court of cassation and said in his grounds of appeal that the ruling had violated the right in defence and said that he provided the court with the documents that confirmed the existence of the employment relationship but the court dismissed this defence.
