This case involved an employee who had been dismissed from their employment because of an accusation of theft. It was wrongly argued although they had not been convicted of the crime there was uncertainty so they could still be dismissed. The court had the power to decide this and ruled the dismissal was unfair and compensation was due.
Background
An employee made a complaint against a company before the Ministry of Labour claiming that he was working at the company and was dismissed from his job because of an accusation of theft. The employee requested the company pay his entitlements and compensation. The Ministry referred the case to the court.
The court ruled that the company should pay the employee 3447.955 Dinars and 3% legal interest.
The company appealed the ruling before the court of appeal. The court amended the appealed ruling and ruled that the company should pay the employee 1947.955 Dinars.
