Evidence – Customary Document – Denial of Signature – Employee’s Rights – Resignation – Salary
The original dispute involved the dues of an employee who had resigned as his salary had not been paid. The court had been wrong to ignore the employee's defence that a customary document used as proof by the employer did not contain his signature.
Background
An employee made a complaint against an employer before the Ministry of Labour claiming that he was working for the employer and had resigned because the employer had failed to pay him the wages for November and December 2003. The employee requested the employer pay his wages and other entitlements. The Ministry referred the case to the court.
The court ruled that the employer should pay the employee 832.67 Dinars.
The employee appealed the ruling before the court of appeal. The court dismissed the appeal and upheld the appealed ruling.
