This case involved a claim for compensation by an employee who had been unfairly dismissed and had suffered a workplace injury. A key issue was that insured employees who suffered a disability were entitled to a specific monthly wage from the social insurance.

Background

An employee filed a case against an employer before the civil court claiming that he was working for the employer and was unfairly dismissed. The employee requested the employer pay him compensation for the damage which had resulted from a workplace injury.

The employer maintained that the employee was subject to insurance rules against workplace injuries and requested the addition of a defendant who was responsible for compensation.

The court ruled that the second defendant should pay the employee 648 Dinars in compensation.

The second defendant appealed the ruling before the court of appeal. The court amended the appealed ruling and ruled the second defendant should pay the employee 529 Dinars in compensation.

The employee appealed the ruling before the court of cassation.
