Legal Renewal – Landlord – Tenant – Tenancy Agreement – Eviction
This case involved eviction of a tenant from a rented shop. The tenancy agreement had prevented the tenant from benefiting from legal renewal so should be deemed invalid.
Background
A landlord filed a case against a tenant before the court requesting the tenant to vacate three rented shops. The landlords said that the tenant rented the shops for two years and seven months and that the two parties agreed on the renewal of the tenancy agreement for the same period unless one party gave notice or otherwise two months before the end of the tenancy agreement. The landlord said that he gave notice to the tenant to vacate the shops within the period but they failed to do so.
The court dismissed the case.
The landlord appealed the ruling before the court of appeal. The court dismissed the appealed ruling and ruled that the tenant should vacate the rented shops.
