The original dispute involved an individual who had rented a car which had an accident and allowed someone else to drive the car in violation of the rental contract. A key issue was the signature on the contract and whether this needed to be proven by written evidence.
Background
A company filed a case against two defendants before the court requesting the defendants pay 8000 Dinars and interest. The company claimed that the first defendant had rented a car from them and he let the second defendant drive the car in violation of the agreed contract. The company said that the second defendant was in an accident and caused damage to the car.
The court ruled that the two defendants should pay the company 5500 Dinars and the value of interest.
The first defendant appealed the ruling before the court of appeal. The court dismissed the appealed ruling ordering the first defendant to pay the maintenance costs.
