Evidence – Oath – Name Change
This case involved an oath which was requested on an amount owed. The fact the claimant had changed their name and provided a photocopy of a ruling in Morocco about this to the court was irrelevant, as they had come to the court and taken the oath and the name change had not been disputed at the time.
Background
A claimant requested the judge to order a defendant to pay them 5000 Dinars. The claimant said that the defendant owed the amount. The judge refused to issue the order and the case was referred to the court.
The court ruled that the defendant should pay the claimant the amount.
The defendant appealed the ruling before the court of appeal. The court upheld the appealed ruling.
