This case involved a claim for unfair dismissal and payment of entitlements including overtime by an employee. The employer was not obliged to prove fair dismissal and the employee was expected to prove it. Overtime was owed as the employer did not deny this or prove they had paid it.
Background
An employee made a complaint against a company before the Ministry of Labour claiming that he was unfairly dismissed from his job. The employee requested the company to pay his entitlements and compensation. The Ministry referred the case to the court.
The court ruled that the company should pay the employee 45 Dinars for the late wages.
The employee appealed the ruling before the court of appeal. The court amended the appealed ruling and ruled the company should pay the employee 185 Dinars and a travel ticket.
