Supply of Services – Remedies – Contract – Evidence – Accountant – Expert
This case involved money which it was claimed was due under a contract for the supply of services. Although evidence had been provided from the company accountant and an expert report, the court was entitled to rely on different expert reports and rule there was insufficient evidence this money was owed.
Background
A claimant filed a case against a company before the civil court requesting the company pay an amount of money. The claimant said that they had agreed with the company to do marketing work but the company had failed to pay the remaining value of the contract.
The court dismissed the case.
The claimant appealed the ruling before the court of appeal. The court dismissed the appeal and upheld the appealed ruling.
