BCC 271/2006

This case involved a request for registration of land and confirmation of its ownership. It was wrongly argued this should not happen as the land had been not be planted and did not have boundaries. A person could own a property that falls under the private estates of the state if they met the legal conditions for its possession for 60 years.

Background

Some claimants filed a case against the department of real estate registration before the civil court requesting the validation of their ownership of a disputed property and the registration of the property under their names. The claimants said that they had inherited the property from their father.

The court ruled that the claimants' ownership of the property should be validated and the property should be registered under the names of the claimants.

The department of real estate registration appealed the ruling before the court of appeal. The court dismissed the appealed ruling and dismissed the case.
