Criminal Ruling – Theft – Equipment – Employee’s Rights – Unfair Dismissal – End of Service Gratuity – Compensation
This case involved a claim by two employees who had been dismissed for their dues. The court was wrong to rule based on the argument they had wasted some equipment and been dismissed as a result, when they had been acquitted in a criminal case of this accusation due to lack of evidence.
Background
Two employees made a complaint against a company before the Ministry of Labour claiming they were working at the company and were dismissed without being paid their entitlements. The Ministry referred the case to the court.
The court ruled that the company should pay the first employee 782.123 Dinars and the second employee 422.50 Dinars and 3% interest.
The employees appealed the ruling before the court of appeal. The court dismissed the appealed ruling on the wages and ruled the company should pay the first employee 333.303 Dinars and the second employee 666.270 Dinars and upheld other points in the appealed ruling.
