This case involved amounts due by an insurance company after a car was damaged in a road traffic accident. The insurance company could refuse to pay repairs if these exceeded the value of the car. It was only liable to pay the difference in value of the car before and after the accident.
Background
Aclaimant filed a case against an insurance company before the court requesting the company to pay him 5305.280 Dinars for maintenance of his car and 2625 Dinars for rent of a new car. The claimant said that his car was damaged in an accident and the car that caused the damaged was insured by the company. The claimant said that the company had refused to pay the maintenance and so he rented a new car.
The court ruled that the company should pay the claimant 5100 Dinars.
The company appealed the ruling before the court of appeal. The court amended the appealed ruling and ruled the company should pay the claimant 1800 Dinars.
