This case involved a claim by a mother on behalf of her children for compensation for the death of their father in a road traffic accident from an insurance company. It was wrongly stated the claim was outside the statute of limitations. This was irrelevant as the children had not reached 18.
Background
A claimant filed a case in person and as a trustee on her sons against an insurance company before the civil court requesting the company pay 30000 Dinars as compensation for damage which had resulted from the death of her husband in a car accident where the car was insured by the insurance company.
The court ruled that the insurance company should pay the claimant 8000 Dinars.
The insurance company appealed the ruling before the court of appeal. The court dismissed the appealed ruling and dismissed the case due to the statute of limitations.
