This case involved eviction following late payment of rent. The key issue was whether this property should be treated as a commercial or residential property for eviction purposes as it was a mixed property which had been rented for commercial purposes.
Background
A landlord filed a case against a tenant before the civil court requesting the tenant to vacate a rented building and pay 60000 Dinars and interest. The landlord said that the tenant was late paying the rent.
The tenant offered to pay the rent but the landlord refused to receive it and so the tenant paid the rent in the treasury of the court.
The court ruled that the tenant should pay the landlord 10000 Dinars for the rent of October 2004 in addition to interest.
The landlord and the tenant appealed the ruling before the court of appeal. The court dismissed the appealed ruling and dismissed the case.
