Employee’s Rights – Loan – Interest – Employment Litigation – Court Fees - Appeal
The original dispute involved interest levied on an employee for a loan by their employer which it was claimed was contrary to labour law. A key issue was whether the appeal should be dismissed as court fees were not paid. The employee in this case was exempt from court fees at all stages of the litigation.
Background
An employee filed a case against an employer before the Ministry of Labour claiming that he worked as a manager for the employer and had received a loan during his service and that the employer received interests on the loan in violation to Article 74 of the Labour Law. The employee requested the employer repay the interest. The Ministry referred the case to the court. The court stated it has no mandate to consider the case and referred it to another court.
The court dismissed the case.
The employee appealed the ruling before the court of appeal. The court dismissed the appeal in form.
