BCC 134/2007

This case involved the claim by an employee for his entitlements after his work permit had ended and he had decided he no longer wished to work. A key question was whether the court could order the employee to pay court fees.

Background

An employee filed a case against an employer before the Ministry of Labour requesting the employer to pay his due entitlements. The employee said that his residence permit in Bahrain had finished and he no longer wanted to work. The Ministry referred the case to the court.

The court ruled that the employer should pay the employee 548 Dinars for the late wages, service pay and a travel ticket.

The employee appealed the ruling before the court of appeal. The court upheld the appealed ruling.

Decision

The employee appealed the ruling before the court of cassation and said in his grounds of appeal that the ruling had violated the right in defence because the court had ordered him to pay fees for the case before the first instance court in violation to Article 155 of the Labour Law.
