Background
An employee made a complaint against a company before the Ministry of Labour claiming that the company recruited him but failed to give him any job. The employee requested the court to pay him compensation and the value of a travel ticket in addition to 1050 Dinars. The Ministry referred the case to the court.
The court dismissed the case.
The employee appealed the ruling before the court of appeal. The court upheld the appealed ruling.
Decision
The employee appealed the ruling before the court of cassation and said in his grounds of appeal that the ruling had erred in the application of law and had insufficient evidence of causation. It was said that the court dismissed the case based on the argument that he failed to prove the working relationship with the company although the visa in his passport mentioned the company was a sponsor for his contract.
