This case involved claims by some employees for their dues on termination of employment. It was ruled the statute of limitations applied. There had been an earlier case which had been dismissed but none of the parties had requested its consideration for over 60 days. Filing a new cases could not alter this.

Background

Some employees made a complaint against a company before the Ministry of Labour claiming that they were working for the company and that the working relationships had finished without them being paid their entitlements. The Ministry referred the case to the court.

The employee failed to attend the hearing and thus the court cancelled the case. The employee renewed the case.

The company argued that the employees had no right to file the case due to the statute of limitations.

The court ruled that the employees had no right to file the case due to the statute of limitations.

The employees appealed the ruling before the court of appeal. The court dismissed the appeal and upheld the appealed ruling.
