Evidence – Photocopy – Delay – Legal Representative – Court of Appeal – Promissory Note
This case involved amounts owed under a promissory note. A key issue was whether the defendant could demand the original copy of the evidence be provided. This had not been requested until the court of appeal stage and the defendant's legal representative had also asked for extra time to provide evidence they had paid the amount.
Background
A claimant requested a judge order a defendant to pay him 5000 Dinars and interest. The claimant said that the defendant owed to him the amount according to a promissory note. The judge referred the case to the court. The legal representative of the defendant requested the court delay consideration of the case so he could provide evidence that the defendant had already paid the amount.
The court ruled that the defendant should pay the claimant the amount and the interest.
The defendant appealed the ruling before the court of appeal. The court upheld the appealed ruling.
