Supply of Services – Evidence – Expert – Appeal
This case involved unpaid amounts for a service. The key issue was whether the correct procedures had been followed by the expert and if photocopies could be used as evidence, although these defences had not been put forward at the correct point.
Background
A company filed a case against an owner of a company before the court requesting he pay 470.478 Saudi Riyals and delay interest. The company said that it agreed with the owner to transfer sand from Saudi Arabia to Bahrain and the owner still owed the amount as transfer fees.
The court ruled that the owner should pay the company the amount and 5% interest.
The owner appealed the ruling before the court of appeal. The court upheld the appealed ruling.
