BCC 494/2005

This case involved whether ownership of land which had been possessed by the claimant's family for a long time should be confirmed. The land was classed as the state's private estate and the necessary possession criteria did not exist.

Background

A claimant filed a case against a defendant before the court requesting the validation of his ownership of land and the issue of an ownership deed. The claimant said that he and his father possessed the property for a long period.

The court ruled that the claimant's ownership of the property should be validation and the defendant should issue an ownership deed for him.

The defendant appealed the ruling before the court of appeal. The court upheld the appealed ruling.

Decision

The defendant appealed the ruling before the court of cassation and said in his grounds of appeal that the ruling had erred in the application of law and said that the court had ruled that the claimant's ownership of the property should be validated though the property fell under the state's private estates.
