This case involved termination of an indefinite employment contract. In such cases compensation for damage should be paid but not pay until the end of the contract.
Background
An employee made a complaint against a company before the Ministry of Labour claiming that he was working for the company and was unfairly dismissed. The employee requested the company to pay his entitlements and compensation. The Ministry referred the case to the court.
The court ruled that the company should pay the employee 59.830 Dinars for holiday pay and 1% interest.
The employee appealed the ruling before the court of appeal. The court dismissed the appealed ruling and ruled he company should pay the employee 300 Dinars for compensation and 46.850 Dinars for severance pay in addition to a travel ticket.
