BCC 445/2005

This case an individual tried to claim reputational damage as a result of accusations on breaching company secrets in a letter. The accusations had previously been part of a criminal case so were already publically known so damage could not be claimed.

Background

A claimant filed a case against a defendant before the court requesting the defendant pay 5000 Dinars and interest.

The defendant sent a letter to the chief of the company claiming that the claimant stole secret details about the activities of the company.

The court dismissed the case.

The claimant appealed the ruling before the court of appeal. The court dismissed the appealed ruling and ruled that the defendant should pay the claimant 200 Dinars.

Decision

The defendant appealed the ruling before the court of cassation and said in his grounds of appeal that the ruling had insufficient evidence of causation and had a contradiction of material documentary evidence. It was said that the court established its ruling based on the argument that the letter sent by the defendant included insults to the claimant though the details he mentioned in the letter were included in a previous criminal case.
