Background

A landlord filed a case against tenants before the civil court requesting the tenants to vacate a rented shop and pay rent arrears and interest. The landlord said that the shop needed maintenance.

The tenants paid the rent during the consideration of the case.

The court ruled that the tenants should pay the landlord 5% interest and they should vacate the rented shop.

The landlord and the tenants appealed the ruling before the court of appeal. The court upheld the appealed ruling.

Decision

The tenants appealed the ruling before the court of cassation and said in their grounds of appeal that the ruling had violated the right in defence and that the court refused to add the case that the landlord had previously filed to the current case.
