Termination of Employment – Notice – Definite Contract
This case involved whether an employee who had resigned without giving notice should pay compensation to the employer because this was stated in the employment contract, even though it was a definite contract.
Background
A company filed a case against an employee before the court requesting the employee pay the company 160 Dinars and interest. The company said that the employment contract agreed between the two parties stipulated that each party had the right to terminate the contract after giving written notice of 30-days, or the party which terminated the contract without notice should pay compensation. The company said that the employee had resigned from his job and ignored the notice period.
The court dismissed the case.
The company appealed the ruling before the court of appeal. The court upheld the appealed ruling.
