This case involved non-payment of salary to employees. A key issue was the deadline for appeal as the employer had been excluded from the case, added and then excluded again and had not been notified of these changes.

Background

Some employees made a complaint against an employer before the Ministry of Labour claiming that they were working as teachers for the employer. The employees requested the employer pay them the wages for August 2002. The Ministry referred the case to the court.

The employees added new defendants to the case.

The court deleted the case.

The employee then made a new request requesting the exclusion of the defendants from the case and filed their case against the school. The employees then added the employer and other defendants to the case.

The court ruled that the employer should pay the employees the wage of August.

The employer appealed the ruling before the court of appeal. The court said that the employer had no right to appeal the ruling.
