This case involved a claim by an employee for entitlements including pay in lieu of notice. The employer had made a claim for a judicial clearance for an unpaid housing allowance. This was rejected as it was made as a defence and not following the correct procedure.
Background
An employee made a complaint against a company before the Ministry of Labour claiming that the company had dismissed him from his job without justification. The employee requested the company pay him his due entitlements and compensation.
The court ruled that the company should pay the employee 11008.005 Dinars and 1% interest and provide him with a certificate of experience.
The company appealed the ruling before the court of appeal. The court dismissed the appealed ruling on the compensation and the pay in lieu of notice and amended the ruling on the late wages but upheld other points in the appealed ruling.
