Debt – Employee – Appeal – Litigation Procedure – Statute of Limitations
This case involved a claim involving non-payment of a loan given to an employee. The key issue was what statute of limitations applied to appeals in such cases.
Background
A company requested a judge to order a defendant to pay 800 Dinars. The company said that the defendant received a loan from the company when they were working for the company and they still owed the amount. The judge refused to order the defendant to pay the amount and referred the case to the relevant court. The court referred the case to the labour court.
The labour court dismissed the case due to the statute of limitations.
The company appealed the ruling before the court of appeal. The court ruled that the company had no right to appeal the ruling because it had failed to make the appeal within the legal deadline.
