This case involved a construction company which had not been paid. Evidence from an expert report found this was because there had been a delay in the delivering the project, however the court was wrong to ignore evidence that the delay was caused by a change in project scope.
Background
A contracting company filed a case against a defendant before the court requesting the defendant to pay him 187532 Dinars and interest. The contracting company said that it had completed contracting works for the defendant and delivered the project but they failed to pay for the contract.
The court ruled that the defendant should pay the company 187.096.675 Dinars and interest.
The defendant appealed the ruling before the court of appeal. The court dismissed the appealed ruling and dismissed the case.
