The initial dispute involved a tenancy agreement which was found to be fraudulent in the criminal courts. This case involved whether there was a contradiction between the civil claims being made and what had been claimed by the victim in the criminal case.

Background

A Respondent filed an action against the Appellant and the introduced opponents in the appeal No 535/1997 demanding the rescission of a leasing agreement concluded between him and the Defendants on 21/09/1996 and he demanded they jointly pay him 1,695,500 AED.

The Plaintiff explained that under the agreement he had rented from the Defendants 13 residential apartments for AED 53,500 per year for each apartment and he wrote a cheque worth 695,500 AED for one year of rent for all the apartments. The defendants refused to deliver him the apartments despite cashing the cheques. He filed a complaint to the authorities accusing them of fraud and they were criminally charged in action No 1205/1997 except the introduced opponent and in spite of that they still refused to pay him the amount and compensation for material and moral damages.
