Background
The Respondent filed the claim No 230/2005 against an individual and their heirs requesting to rule upon the validity of the contract of sale concluded between them and the deceased and to obligate the heirs to transfer ownership of the land subject of the sale In Abu Dhabi and on the basis that they had purchased it on 6/5/1990 d from the legator a contract entered in on 26/5/1990 and on 27/5/1990 the heir presented an proxy power to the agency notarized authorizing him to freely dispose of the property by mortgage, sale or lease, and that he may register it in his name or in the name of a third party. On 11 May 1993, they sold the same piece to 2,940,000 AED, from which they paid 2,900,000 AED in a cheque and the rest worth 40,000 AED was paid on 21/5/1993.
The sale was issued before the decree prohibiting sale on 14/3/1997. Abu Dhabi Law No. 3/2005 stipulated that real estate may be registered only with citizens.
