Sale of Goods – Debts – Evidence – Witness
The original dispute involved unpaid goods. The key issue was whether the witnesses lacked the ability to be witnesses in this case and if because of the amount involved written not witness evidence was needed.
Background:
A Respondent establishment had filed a suit against the Appellant under roll No 15 of 2002 (Civil - Al Ain), requesting payment of 116320 AED and legal interest, on that basis that they had received agriculture tools and material and failed to pay for them.
Proceedings:
Al Ain Court of First Instance - Decision No 15 of 2002
Rejected the lawsuit.
Al Ain Court of Appeal - Decision No 243 of 2002
The Court referred the matter to investigation, and after hearing of the witnesses it granted the Respondent's claims.
The Appellant therefore filed an appeal before the Federal Supreme Court.
