ADCOC 93/2025

The case involved a creditor's attempt at property execution through public auction of seized property that was obtained through government grants. The creditor sought to sell the Usufruct Rights of multiple properties, but the court upheld residential property protection laws, ruling that government-granted residences cannot be subject to seizure for debt recovery unless mortgaged for their purchase.

Background

An Appellant, the creditor in Execution File No. 1552/2015 (Commercial Execution Abu Dhabi), requested the Internal Execution Judge No. 36/2024 to order the inclusion of seized properties for sale by public auction. These properties were located in the Emirate of Abu Dhabi. The Appellant also requested the Sales Department to include the seized properties under this execution for sale by public auction, contingent upon meeting all inclusion requirements. This request was based on the claim that the Appellant had not received the full amount owed, and a prior decision had been issued to include all seized properties for sale based on the remaining amount in the distribution list. Therefore, the purpose was to sell these two properties at auction.
