This case involved a payment order for a bounced cheque. The correct procedures were considered.
Background
A Respondent filed Order for Payment Petition No. 1220/2024 in the Abu Dhabi Commercial Court, requesting that the Appellants be jointly and severally obliged to pay them AED 1,716,000.00, plus interest at 12% per annum from the due date of 1 June 2021, until full payment, as well as compensation of AED 300,000. The petition asserted that the Appellants owed this amount to the Respondent as a result of commercial dealings between them. The second Appellant, acting as the authorised signatory for the first Appellant, subsequently issued 12 cheques (numbers...) drawn on the first Appellant's account at Bank in favour of the Respondent. These cheques were returned unpaid due to insufficient funds, as confirmed by the bank. Despite formal demand for payment, the Appellants refused to pay the amount owed, leading the Respondent to file the aforementioned Order for Payment petition.
