Background
A Respondent company filed case No. 1061/2021 (Commercial, Partial – Abu Dhabi), seeking a ruling obliging the Appellant company to pay AED 6,357,964.07 along with AED 500,000 in compensation and legal interest at 12% annually from the date of the judicial demand until full payment.
The Respondent company based its claim on the rental of equipment and machinery to the Appellant, as well as the supply and installation of works for the project specified in the statement of claim. The claimed amount was established based on a consulting expert report and an extracted account statement from the Respondent’s properly maintained commercial records. The Appellant refused to pay despite repeated demands, prompting the lawsuit.
